Limitation of Liability:

TreeSeeds.com - maximum liability whether contractual or negligence or otherwise, is limited to the amount paid to TreeSeeds.com for the purchase of seeds under all circumstances and regardless of the nature, cause, or extent of the loss.

Non-guarantee: All seeds are sold "as is" without warranty, expressed or implied, as to description and productiveness. Goods should be inspected upon arrival and claims for condition made at once. We cannot consider claims after seeds have been stored or planted. Purity and germination of seeds, when mentioned are for information only and without guaranty. We are specifically not responsible for the phenomenon of hybridization often unforeseen in spite of all the care taken in regard to selection of the seed source. It is expected that all seed is offered for sale contingent upon crop yield and prior sale.

Buyer assumes ownership and responsibility for the goods at the time of shipment; however, TreeSeeds.com retains a vendors interest in all goods until such payment has been made in full.

Shipping:All seeds shipped at Buyer's risk and expense from our seed department in Winooski, Vermont. We charge for packaging materials at our cost. Unless given specific instructions we will ship by the method we think best. Receiving and Acceptance:Seed is perishable. All shipments are to be immediately and carefully unpacked and inspected on arrival and then placed in proper storage. Any problems with the condition or quality or quantity of goods received should be brought to our attention immediately. Quantity is proven by shipping documents.

Claims:Claims for any cause must be made in writing within 5 days after arrival of goods, which period of time is expressly agreed to be reasonable. If the buyer does not give such notice, Buyer agrees to have irrevocably and unconditionally accepted the goods. TreeSeeds.com furthermore will not consider any claim after seed has been cleaned, processed, improperly stored, planted, or otherwise treated, modified or used in any way.

No Guarantee:

Seeds are sold with no guarantee. TreeSeeds.com is not responsible for germination percentages once the customer receives the seeds. We do not refund orders or partial orders due to low or no germination success. We do not resend seeds due to low germination or zero germination. Customers should have an indoor growing light, seed starter heat mat, seed starting mix and access to water for successful germination. Germination rates are displayed on each seed product page.

International Customs Problems:

If an order is rejected at customs and not able to be delivered to the customer - the package will be resent to us (sender). International orders can take 1-3 months to return to sender. Please check with your country laws on importing the seeds you want to order. Not all seeds can be shipped to countries outside of the USA/Canada. TreeSeeds.com will not reship or refund your order until the seeds have returned to sender. It is the responsibility of the customer to make sure the seeds he/she is purchasing can be cleared through customs. You may need to request permits through your countries department of agriculture to import seeds into your country,

Undeliverable Orders:

Definition: Orders that can't be delivered due to customer address error's (Customer provides TreeSeeds.com with an invalid address.) Most orders shipped within the USA will be returned to sender in 2-4 weeks. International orders (Canada & beyond) may take 2-4 months to return to sender. Once the order has been returned to us - we can:

  • Reship the order. The customer is required to pay shipping charges to reship his/her order.
  • Refund the order minus a 25% restocking fee & shipping charges to the customer.
  • We will not reship the order until the post office sends the order back to us.

Invalid Shipping Address:

The customer is responsible for entering an accurate address for shipping the order. If the customer enters an invalid address – the order will still be shipped. The customer is responsible for making payment again to have his/her order re-shipped. The customer is responsible for entering his or her shipping address in accurate form including house number, street address, city, state, country – province if applicable for outside the United States. If the customer resides in an apartment or unit, the customer is responsible for making this clear when entering his or her shipping address. TreeSeeds.com will not pay to have said customers order re-shipped at our expensive. This is the responsibility of the customer to pay to have the order shipped to an accurate and valid shipping address. In the event of a customer refund request - the customer will be refunded minus a 20% restocking fee and the shipping paid for on our end. Undelivered mail can take 2 weeks to 3 months to return to sender. Refunds will not be made until the order has been returned to sender.

Multiple Seed Quantities Per Bag:

Each seed species is packed in its own clear bag. If the customer orders 25 seeds/ quantity 4, then 100 seeds will be packaged in the same clear bag. Example: 500 Seeds / quantity 2 then 1,000 seeds would be packed in the same clear bag. If you require additional bags for promotions or events, you may email us to request purchasing additional clear bags at .25 each.

By acceptance of the seed, the buyer acknowledges that the conditions of sale and that the limitations and disclaimers herein described are the conditions of sale and that they constitute the entire agreement between buyer and seller.
